Action 1: Trump DOJ Moves Towards Abandoning Disability Rights Protections

Last month, the Justice Department’s Office of Legal Counsel released a memo undermining a landmark Supreme Court decision protecting the rights of people with disabilities.

In Olmstead v. L.C., the justices ruled that segregating these folks who are otherwise able to live in their communities with proper supports was discriminatory. State and federal governments have ever since worked to provide disability services in the most integrated, mainstream setting possible to comply with the Americans With Disabilities Act and Section 504 of the Rehabilitation Act. Trump’s DOJ is now arguing, in what they admit is “out of step” with how everyone else interprets current law, that the Olmstead ruling just means people can’t be institutionalized without justification, and there’s no requirement to provide the structures they need to live their lives outside of institutions.

This means the power of the federal government may no longer be used to enforce these rights, taking away a major safeguard for this community. States will increasingly be able to get away with re-segregating disabled people if they choose.

Senator Tammy Duckworth (D-IL) has introduced S. Res. 790, calling on the Justice Department to rescind the memo and reverse the Medicaid cuts which are shredding services that allow disabled people to live independently. (Duckworth is a double amputee from her service in the Iraq War.) While it’s not binding, it’s a vehicle to put elected officials on the record and get them to make commitments we can hold them to in future legislative battles and government funding fights.

Action 2: Protect Bears Ears and Grand Staircase-Escalante

Trump has signed an executive order drastically reducing the size of Bears Ears and Grand Staircase-Escalante in Utah, making this now the second time he has attempted to shrink these two world-renowned national monuments. 

Bears Ears, which is considered sacred land by many tribal nations, was designated a national monument by President Obama in 2016, while the geographically and scientifically significant Grand Staircase-Escalante, designated in 1996, is one of the world’s richest sources of Triassic era fossils. Both monuments were created under the Antiquities Act of 1906, which gives presidents the explicit authority to create national monuments, but says nothing about the power to abolish or modify them once established.

Preserving these public lands is overwhelmingly popular, not only in Utah, but throughout the Western United States. Trump’s executive order opens up these established national monuments for potential mining, drilling, and large-scale commercial development. Congress should enact legislation that protects the rich biodiversity, unique geology, and cultural significance of these important public lands.
